These terms govern your use of the Port Way website and mobile app, and any shipment you book through them. By creating an account, requesting a quote, or confirming a booking you accept these terms. Please read them before you book.
Port Way is a freight forwarding and logistics company based in Egypt. We arrange sea and land transport, customs clearance and related services. We act as a forwarder arranging carriage with shipping lines, transport providers and other suppliers; we are not the vessel operator unless we tell you otherwise in writing.
You need an account to book a shipment. You are responsible for the accuracy of the details you register, for keeping your password confidential, and for everything done through your account. Tell us immediately if you believe someone else has access to it. One person or company should not maintain multiple accounts for the same business without telling us.
A price shown in search results is an offer for the route, container type and dates it describes, and is valid only for the period stated on it. Prices are subject to the surcharges, local charges and government fees listed in the cost breakdown. A quote does not reserve space on a vessel and does not become binding until we confirm your booking.
A booking starts as a draft. It becomes a request to us once you submit your shipment declaration, and it is only accepted once we mark it confirmed — we will email you at each step. We may decline a booking, for example where space, the cargo or the route is unavailable, in which case nothing is owed and we will suggest alternative sailings where we can.
You are responsible for the accuracy and completeness of everything you give us: shipper and consignee details, cargo description, weights, HS codes, and every document you upload. Customs authorities act on that information. Delays, fines, storage charges, re-inspection costs or seizures caused by wrong, missing or late information are for your account.
You may not book cargo that is illegal to export or import, subject to sanctions, counterfeit, or otherwise prohibited by the carrier or by the authorities at origin or destination. Dangerous, hazardous, temperature-controlled, oversized and high-value cargo must be declared to us in advance and accepted by us in writing before shipment.
Charges are payable as agreed on your booking. Unless we have agreed credit terms with you in writing, payment is due before release of the cargo or its documents. Amounts that fall outside the quoted price — demurrage, detention, storage, customs inspection, re-handling, or charges imposed by an authority — are invoiced separately as they arise.
You may request a change to a booking from your shipment screen; a change is only effective once we approve it, and it may change the price. Cancellation after confirmation may attract charges already incurred with the carrier or the port. If we cancel a shipment, we will tell you why and offer alternative sailings where available.
Sailing dates, transit times and arrival estimates are indications given in good faith by the carrier and are not guaranteed. Tracking events are published as we receive them from the carrier, the port or our agents. We are not liable for loss caused by a delay, a schedule change, a missed connection, port congestion or a customs hold.
Our liability for loss of or damage to cargo is limited to the limits set by the mandatory international conventions and the carrier terms that apply to the leg concerned. We are not liable for indirect or consequential loss, including loss of profit, loss of market or loss of contract. Nothing in these terms excludes liability that cannot be excluded by law.
Cargo insurance is not included in a quoted price unless it appears as a line in your cost breakdown. Standard carrier liability is far below the value of most cargo, so we recommend arranging all-risks cargo insurance. We will arrange cover on your instruction, as your agent and at your cost.
The service is provided for legitimate commercial shipping use. You may not scrape our rates, resell access to the service, attempt to gain access to another account or to our systems, or interfere with the service. The content, design and data of the site and app remain ours.
We may suspend or close an account that breaches these terms, that is used for unlawful cargo or fraud, or that has unpaid charges. You may close your account at any time from the app; bookings already in progress and records we are legally required to keep are not affected.
We may update these terms as our service and the regulations around it change. The date at the top of this page shows when they were last revised, and the terms in force when you confirm a booking are the ones that apply to that booking.
These terms are governed by the laws of the Arab Republic of Egypt, and the courts of Egypt have jurisdiction over any dispute arising from them, without prejudice to any mandatory rule of the carriage convention that applies to a particular shipment.
